Terms of Service

1. Who we are
ManagedHorizons is operated by Luke Eccles, a sole trader trading as ManagedHorizons, of Unit 171046, PO Box 7169, Poole, BH15 9EL, United Kingdom. Legal notices may be sent to legal@managedhorizons.com. General support is available at support@managedhorizons.com.
2. Who may use the service
You must be at least 18 years old and able to enter into a binding agreement, or be acting with the authority of a business or other organisation that can enter into this agreement. You must provide accurate information and must not create an account for someone else without authority.
ManagedHorizons is operated from England and may be made available internationally. Customers outside the United Kingdom are responsible for checking whether use of the service is lawful and suitable in their location. Nothing in these Terms removes mandatory rights that apply under local law.
3. The service
ManagedHorizons helps customers manage contacts, appointments, reusable messages, scheduled email campaigns, support requests and related administration. Accounts are currently designed for a single account holder. Customers remain responsible for how they use the service and for the information and messages they upload, schedule or send.
Features may depend on third-party infrastructure such as hosting, email delivery, payment and queue providers. We may make reasonable changes to maintain security, legal compliance, compatibility or reliable operation.
4. Accounts and security
- You must keep passwords, recovery information and devices secure.
- You are responsible for activity carried out through your account unless it was caused by our failure to use reasonable care.
- You must tell us promptly if you suspect unauthorised access.
- You must not share access in a way that bypasses plan, security or account limits.
- Administrative accounts are protected by mandatory multi-factor authentication. Customer multi-factor authentication may be introduced later.
5. Acceptable use
You must not use the service for spam, phishing, fraud, harassment, unlawful discrimination, malicious software, stolen data, deceptive impersonation, security attacks, evasion of suppression or unsubscribe controls, or any activity that unlawfully harms recipients, providers, other customers or ManagedHorizons.
You must not scrape the service, probe or attack its security, bypass technical restrictions, interfere with another customer, introduce harmful code, use automated access outside documented interfaces, resell or white-label the service, or use it to build or operate a substantially competing copy.
Contact lists and messages must be collected and used lawfully. Purchased, rented, scraped or otherwise unlawfully obtained lists are prohibited. You must honour recipient choices, keep required records and have an appropriate lawful basis for communications.
6. Suspension, investigation and termination
We may restrict, suspend or terminate access where we reasonably believe there is serious or repeated unlawful, fraudulent, abusive or security-threatening use; a material breach of these Terms; payment fraud; or a material risk to recipients or service infrastructure.
Automated safety systems may temporarily pause sending or suspend access, including after payment failure, repeated failed logins, high bounce or complaint rates, or other serious risk indicators. You may contact support to request review. We may act immediately where delay could cause harm.
7. Free trial, plans and renewal
ManagedHorizons currently offers a 30-day free trial without requiring a payment card. No payment is taken merely because the trial ends. To continue with paid access, the customer must actively select and purchase a plan.
The available plans are currently £18 per month or £180 per year. ManagedHorizons is not currently VAT-registered, so VAT is not currently charged. Prices, included usage and plan details are shown before payment.
Paid subscriptions renew automatically at the selected monthly or annual interval until cancelled. Cancellation takes effect at the end of the current paid billing period, and access continues until then unless the account is suspended for misuse, fraud, security risk or failed payment.
8. Payments
Payments are processed through Stripe using the ManagedHorizons checkout and billing interface. ManagedHorizons does not store full card details.
You confirm that you are authorised to use the payment method supplied. A failed or reversed payment may result in immediate suspension. You may create a support ticket to resolve a genuine billing issue.
9. Cancellation, cooling-off rights and refunds
You can cancel a paid subscription through the available billing tools or by contacting support. Cancellation normally takes effect at the end of the current paid billing period.
Consumers may have a legal right to cancel certain distance contracts within 14 days. Where immediate access to a paid digital service is requested, we may ask for express consent to begin supply during that period and explain how this affects cancellation rights. Nothing in these Terms removes rights that cannot lawfully be excluded.
We do not routinely provide partial-period refunds. We will correct duplicate charges and clear billing mistakes, comply with mandatory refund rights, and may issue a discretionary refund where fair in the circumstances.
10. Customer content and data responsibilities
You keep ownership of content and business data you upload. You give us a limited, non-exclusive permission to host, copy, process, render, queue, transmit and back up that content only as needed to provide, secure and support the service.
You confirm that you have the rights and lawful basis needed to upload and use that content. You are responsible for notices to contacts and recipients, message content, recipient selection and compliance with marketing, privacy and communications law.
11. ManagedHorizons intellectual property and licence
ManagedHorizons, including its software, interface, workflows, branding, designs, documentation and original materials, belongs to us or our licensors and is protected by intellectual property law.
While your account is permitted to use the service, we grant you a limited, revocable, non-exclusive and non-transferable right to access it for your own personal or internal business purposes. This does not transfer ownership.
12. Feedback
You do not have to provide product suggestions. Where you voluntarily provide feedback, you allow us to use it to improve the service without payment or obligation, provided we do not claim ownership of your confidential information.
13. Confidentiality
Each side must use reasonable care to protect non-public information received from the other and use it only for the agreement or as required by law.
14. Third-party services
The service uses third-party providers including Amazon Web Services, Stripe and RaidHost. Their services may be governed by their own terms and availability. We remain responsible for our own legal obligations but are not responsible for independent services outside our reasonable control.
15. Availability and maintenance
We aim to provide a reliable service but cannot promise uninterrupted or error-free availability. Maintenance, provider outages, internet failures, attacks, legal requirements and events outside reasonable control may affect access.
16. Service expectations
We will provide the service with reasonable care and skill. You remain responsible for reviewing campaigns, recipients, dates, business decisions and exported information.
17. Liability
Nothing excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or other liability that cannot legally be limited.
Subject to mandatory law, neither side is responsible for losses that were not reasonably foreseeable when the agreement was made. Where legally permitted, we are not liable for indirect loss of profit, revenue, business, anticipated savings, goodwill or data.
Subject to the paragraph above and any liability that cannot legally be limited, our total liability arising from or connected with the service will not exceed the total fees you paid to ManagedHorizons during the 12 months immediately before the event giving rise to the claim. If you paid no fees, this cap does not remove any minimum remedy required by law.
18. Claims caused by customer misuse
Where permitted by law, you will be responsible for direct losses, provider charges or third-party claims caused by your unlawful content, unlawful contact lists, fraud, deliberate security abuse or material breach of these Terms.
19. Account closure and deletion
You may request deletion by contacting legal@managedhorizons.com. You should export any information you need before closure.
We use a seven-day grace period before completing deletion, unless faster action is required for security or law. After that period, active customer content will be deleted or irreversibly anonymised as soon as reasonably possible, subject to weekly backup snapshots and records that must be retained for accounting, security, disputes, fraud prevention, legal claims or suppression obligations.
20. Changes to these Terms
We may update these Terms for legal, security, provider or material product changes. We will identify the current version and give reasonable notice of material changes where required.
21. Notices
We may send account, legal, security and billing notices to the email address associated with your account or display them within the service. Formal notices to us should be sent to legal@managedhorizons.com and, once published, to the correspondence address in section 1.
22. Standard contract terms
- Assignment: you may not transfer this agreement without our written consent. We may transfer it as part of a genuine reorganisation, financing or sale, provided this does not reduce your legal rights.
- Severability: if part of these Terms is unenforceable, the rest continues to apply.
- Waiver: a delay in enforcing a right does not permanently waive it.
- Entire agreement: these Terms, the Privacy Policy, the plan information shown before purchase and any agreed data-processing terms form the agreement about the service.

These Terms are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction, except where mandatory consumer law gives you the right to bring proceedings elsewhere.
